1. Introduction

Welcome to Polydiem Auto Export LLC (“Polydiem,” “we,” “our,” or “us”).
By using our website, services, and tools (“Services”), you agree to these Terms and Conditions (“Terms”) and our Privacy Policy.
If you do not agree, please do not use our Services.

2. Description of Services

Polydiem helps clients search, bid on, and purchase vehicles from U.S. auctions, dealers, and private sellers.
We assist with documentation, title transfer, domestic transportation, and international shipping,
and provide transparent tracking for registered customers.

3. Modification of Terms

We may update these Terms at any time without prior notice.
The latest version will always be available on our website.
Continued use of our Services constitutes acceptance of the revised Terms.

4. Eligibility and Account

You must be at least 18 years old and legally capable of entering into an agreement.
You are responsible for all activities under your account.
If unauthorized access is suspected, notify us immediately.
We may suspend or terminate accounts at our discretion.

5. Security Deposit (Flexible)

A refundable security deposit is required before full bidding access.
Standard: 10% of your maximum bid amount, minimum $600, unless otherwise agreed in writing.
100% refundable if there are no unpaid invoices, active bids, or pending transactions.
Refunds are processed within 2 business days (bank processing times may vary).
Deposits may be used to cover resale costs or unpaid balances if a buyer fails to complete payment.

6. Bidding and Purchase

All bids, offers, and “Buy Now” submissions are final and non-reversible.
Auction increments may vary; Polydiem may raise your bid by one increment within your limit.
All vehicles are sold “AS-IS, WHERE-IS” with no warranties, express or implied.
Buyers must verify condition, title, and documentation before bidding.
Polydiem is not responsible for dropped bids, auction errors, or third-party delays.
Polydiem’s decision will be final in any dispute related to bidding or purchase.

7. Payment (Flexible Deadlines)

Full payment is due within 48 hours of invoice issuance unless otherwise agreed.
Late fee: $50 per day plus any applicable auction penalties.
Failure to pay within 7 days may result in cancellation and resale, with a minimum $295 fee.
Accepted payment methods: Bank Transfer, ACH, Zelle, or in-person bank deposit.
Payments must come from the registered buyer’s verified account.
Buyer is responsible for all bank or wire fees.

7A. Escrow (Optional Secure Payment Holding)

Polydiem may use a licensed third-party escrow service or designated U.S. bank to hold funds securely before title transfer or shipment.

Provider: Licensed escrow or Polydiem’s designated financial institution.
Activation: Escrow applies only if agreed in writing prior to payment.
Fund Release: Funds are released after shipment or title issuance.
Dispute Handling: Funds remain in escrow until both parties agree to resolution.
Fees: Escrow and banking fees are normally paid by the buyer.
Disclaimer: Polydiem is not liable for delays or actions of the escrow provider.
Optional Use: Escrow may be required or declined depending on transaction size or buyer country.

8. Shipping and Delivery

Transport within the U.S. is handled by licensed third-party carriers.
Polydiem is not responsible for damage, delay, or loss during shipping.
Buyer must inspect and photograph the vehicle upon delivery.
Delivery times may vary due to weather, auction schedule, or customs delays.
Additional equipment or storage costs are the buyer’s responsibility.

9. Title, Registration, and Taxes

Buyer is responsible for verifying title accuracy and clearing any liens.
Title delays or reissue costs are not covered by Polydiem.
Buyers outside Washington or California handle their own registration and taxes.
Vehicles with branded titles (Salvage, Rebuilt, etc.) may not be registrable.
Sales tax is collected only when required by law.

10. Vehicle Information

All vehicle data is provided for reference only and may contain errors or omissions.
Buyers are encouraged to conduct independent inspections.
Polydiem does not guarantee the accuracy or completeness of any vehicle listing information.

11. Prohibited Activities

Users must not:

Interfere with or disrupt site functionality.
Impersonate others or provide false information.
Upload malware, spam, or harmful code.
Infringe copyrights or trademarks.
Use scraping, bots, or automated access tools.

12. Intellectual Property

All content, design, and logos on this website are owned by Polydiem or its licensors.
Reproduction or redistribution without written consent is prohibited.

13. Disclaimer of Warranties

All Services are provided “AS-IS” and “AS-AVAILABLE.”

Polydiem disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and accuracy.

14. Limitation of Liability

Polydiem is not liable for indirect, incidental, or consequential damages, including loss of profits or data.
Service use is at the user’s own risk.

15. Indemnification

Users agree to indemnify and hold Polydiem harmless from any claims or losses arising from their use of the Services or violation of these Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, USA.
All disputes shall be resolved through binding arbitration in Los Angeles County, California under JAMS or AAA rules.
Both parties waive the right to a jury trial or class action.
